fa بررسی و تحلیل موضوع کفایت در متولی موقوفات تخصصي Special پژوهشي Research <em><span dir="RTL" style="letter-spacing:-.1pt;"><span style="font-family:Arial,sans-serif;"><span style="font-size:10.0pt;">اسلام به زوایای مختلف زندگی انسان همچون ابعاد مادی و معنوی توجه داشته است. از جمله مسائل مهم اقتصادی در اسلام، بحث وقف است. وقف در اصطلاح فقهی، عبارت است از: حبس کردن عین مال، یعنی برای ابد فروش و انتقال آن به غیر را ممنوع سازند و منافع آن را به‌طور رایگان در اختیار اشخاصی حقیقی یا حقوقی قرار دهند. از جمله مسائلی که در بحث وقف، مطرح است، ویژگی و شرایط متولی موقوفات است. از همین‌رو مسئله اصلی این مقاله، بررسی بحث کفایت در متولی موقوفات است. جهت پاسخ‌دهی به این مسئله با روش توصیفی ـ تحلیلی به بررسی آن پرداخته خواهد شد. دقت در نظرات فقهای عظام و حقوق‌دانان و اساتید و حتی عرف متشرعه به این نتیجه می‌رسیم که متولی موقوفه ناگزیر است علاوه بر صلاحیت‌های عمومی، امانت‌داری و توانایی و آشنایی و قدرت بر اداره وقف داشته باشد که می‌توان همه این مجموعه را کفایت نامید متولی در هر موقوفه به‌حسب همان موقوفه خواهد بود.</span></span></span></em> <em>Islam has taken heed of various aspects of human life such as material and spiritual dimensions. One of the important economic issues in Islam is waqf. In jurisprudential terms, waqf refers to the confinement of property itself, that is, to prohibit the sale and transfer of it to others forever and to provide its benefits to a natural person or a legal person for free. The characteristics and conditions of the administrator of mawqufat is one of the issues in the discussion of waqf. Therefore, this article mainly deals with the competency of the administrator of mawqufat. The descriptive-analytical method has been used to examine this issue.
