other نقش مقاصد الشریعه در تفسیر فقهی قرآن تخصصي Special پژوهشي Research <i><span dir="RTL" lang="AR-SA" style="font-size:11.0pt"><span style="line-height:115%"><span style="font-family:IRBadr">تفسیر فقهی قرآن همواره به‌عنوان یکی از مهم‌ترین عرصه‌های تعامل میان نص قرآنی و زندگی اجتماعی مسلمانان مورد توجه قرار گرفته است. در این میان، مقاصد الشریعه به‌عنوان مجموعه‌ای از اهداف و حکمت‌های کلی شریعت، نقش اساسی در هدایت روند استنباط و فهم نصوص ایفا می‌کند. با وجود اینکه در روش‌های سنتی تفسیر، توجه عمده به ظاهر الفاظ و قواعد اصولی معطوف بوده، تحولات اجتماعی و پیچیدگی‌های روابط انسانی ضرورت بازنگری در این رویکرد را آشکار ساخته است. رویکرد مقاصدی با تمرکز بر مقاصد ضروریه همچون حفظ دین، نفس، عقل، نسل و مال و همچنین توجه به مصالح حاجیه و تحسینیه، امکان تفسیر پویاتر و متناسب‌تر با شرایط زمان و مکان را فراهم می‌آورد. این مقاله با بررسی مبانی نظری مقاصد الشریعه، سیر تاریخی آن در میان اندیشمندان اهل سنت و شیعه، و تحلیل روش‌شناسی مقاصدی، می‌کوشد ظرفیت‌ها و چالش‌های این رویکرد در تفسیر فقهی قرآن را روشن سازد. همچنین نمونه‌هایی از آیات مرتبط با عبادات، معاملات، احوال شخصیه و مجازات‌ها مورد بررسی قرار گرفته تا نحوه کاربست عملی مقاصد در فهم نصوص قرآنی آشکار گردد. یافته‌ها نشان می‌دهد که بهره‌گیری از مقاصد الشریعه نه به معنای کنار گذاشتن نص، بلکه در جهت تکمیل و تعمیق فهم آن است و می‌تواند به تحقق عدالت، رفع تعارضات ظاهری و پاسخگویی به نیازهای معاصر جامعه اسلامی یاری رساند.</span></span></span></i> <i><span style="font-size:8.0pt"><span style="line-height:115%"><span style="font-family:&quot;Times New Roman&quot;,&quot;serif&quot;">Jurisprudential exegesis of the Qur&rsquo;an has always been regarded as one of the most significant arenas of interaction between the Qur&rsquo;anic text and the social life of Muslims. Within this field, maqāṣid al-sharīʿah&mdash;the overarching objectives and wisdoms of the Islamic law&mdash;play a crucial role in guiding the process of interpretation and derivation of jurisprudential commandments. While traditional exegetical methods primarily focused on the apparent meanings of words and classical principles of jurisprudence, social transformations and the increasing complexity of human relations have highlighted the need to reconsider these approaches. The maqāṣid-oriented perspective, with its emphasis on essential objectives such as the preservation of religion, life, intellect, lineage, and property, along with its attention to complementary and enhancing benefits (maṣāliḥ ḥājiyyah and taḥsīniyyah), offers the potential for a more dynamic and context-sensitive interpretation aligned with the realities of time and place. This article examines the theoretical foundations of maqāṣid al-sharīʿah, traces its historical development among Sunni and Shi&lsquo;i scholars, and analyzes its methodological dimensions in order to elucidate the capacities and challenges of this approach in Qur&rsquo;anic jurisprudential exegesis. The study also explores examples of Qur&rsquo;anic verses related to acts of worship, commercial transactions, personal status laws, and penal commandments in order to demonstrate how maqāṣid can be practically employed in understanding the Qur&rsquo;anic text. The findings indicate that the use of maqāṣid al-sharīʿah does not entail abandoning the text; rather, it enriches and deepens textual understanding.
